Honeywell’s Damages Success May Be Hard for Others to Repeat

Phillips & Cohen partner Claire Sylvia tells Bloomberg News that a recent federal appeals court ruling won’t change liability in whistleblower legal cases.

Each defendant in an FCA case remains responsible for the entire amount of the liability after this ruling, said Claire M. Sylvia, who represents whistleblowers with Phillips & Cohen LLP in San Francisco.

Therefore, the “the incentives to pursue all parties responsible for a particular FCA violation remain unchanged,” she said.

Sylvia has been named one of the “500 Leading Plaintiff Financial Lawyers” for the past four years by Lawdragon magazine based on her work representing whistleblowers.
