In a Law360 article, Phillips & Cohen partner Jeffrey Dickstein criticizes Wheeling Hospital’s countersuit against his whistleblower client, who alleged in a qui tam lawsuit that the West Virginia hospital was violating Stark and Anti-kickback laws.
The hospital countersued Longo in West Virginia, claiming he was falsifying the alleged kickback scheme in order to secure a settlement and should have made his reports through hospital channels, but withdrew that suit in June 2019, court records showed.
“Intimidation is a scare tactic often used against whistleblowers,” said Jeffrey W. Dickstein of Phillips & Cohen LLP, representing Longo. “We are not going to tolerate baseless lawsuits against our clients.”
