Phillips & Cohen partner Erika Kelton tells Law360 that the CFTC’s recent efforts to draw in new whistleblowers with a series of informational alerts should send an emboldening message to potential whistleblowers.
The focus on areas typically associated with FinCEN and the DOJ comes as the CFTC filed a record number of cases accompanied by criminal charges last year, and it seems to be a recognition that many of these lawsuits are hard to pursue without insider knowledge, said Phillips & Cohen LLP whistleblower attorney Erika Kelton.
“You don’t normally think of the CFTC as the regulator that’s enforcing money laundering regulations, right?” she said. “I think it’s very wise that they’re putting out this alert to potential whistleblowers so that people who might feel like there really isn’t a pathway for them understand that there might be.”
