Target to pay $3M over Medicaid Rx refill rules

Bloomberg Law quoted Phillips & Cohen partner Erika Kelton in an article about Target Corp.’s settlement of whistleblower allegations that it had violated prohibitions on automatic prescription refills for Medicaid patients. Walmart Stores Inc. faced a similar case in 2018.

The combination of cases signals the federal government’s aggressive stance in pursuing refill cases, said Erika Kelton, a Phillips & Cohen LLP partner who represented whistleblowers in health-care cases against GlaxoSmithKline Plc. and Pfizer Inc.

“Although neither settlement was huge compared to some billing fraud cases, two settlements in seven months send a strong message that the government is serious about enforcing the prohibitions against auto-refills for Medicaid patients,” she said in an email sent to Bloomberg Law Dec. 11.
