Claire M. Sylvia, a partner at Phillips & Cohen, spoke to Bloomberg BNA’s Health Care Fraud Report about a unique False Claims Act medical necessity case.
Claire M. Sylvia, a partner with Phillips & Cohen LLP in San Francisco told Bloomberg BNA June 28 that “[d]ifferences in professional judgment about medical necessity or other types of claims for payment do not preclude a conclusion that a claim is false.” Sylvia added, “If they did, the False Claims Act would be severely undermined, given that many government programs involve technical requirements that involve professional judgment.”
